What is an EPA Prosecution?

An Environmental Protection Act (EPA) Prosecution is to provide tenants suffering in bad conditions with a solution, known as a statutory nuisance. A statutory nuisance includes any premises in a condition that is harmful to health and/or nuisance, for example, an infestation of rodents.

Through EPA tenants can serve a notice to their landlord to remove the bad living conditions within 21 days. If the conditions are not resolved within 21 days you can ask the Magistrates Court to issue a summons to prosecute the responsible party to remove or prevent the nuisance.
