Damp and Mould

Home / Housing Law / Damp and Mould

Do you have issues with damp and mould in your property? Is your landlord, local authority or housing association ignoring you?

At Watson Woodhouse, our solicitors can help resolve the damp and mould issues in the property you reside in by making a claim against your housing provider. We can also look into making an Environmental Protection Act (EPA) Prosecution.

According to official figures, around 120,000 households in social housing in England live with condensation and mould, which is three times the proportion of privately owned homes.

Mould is a fungus that decomposes dead organic materials and grows in damp, moist areas. No one wants to live in a mould-infested house; not only does it look unhygienic, but it also causes various problems.

Causes of Damp and Mould

Damp can take several forms, but the most common are rising, condensation and penetration. Rising damp is caused by water below the building rising through materials like bricks and rocks. Condensation damp is caused by moisture in the air. Finally, penetration damp is caused by structural problems. The most common causes of damp are:

  • Excess Moisture
  • Condensation and poor ventilation
  • Leaking roof, pipes and guttering
  • Rain seeping into the property
  • Faulty plumbing and heating

Landlords have a responsibility and duty of care to their tenants; they must ensure the property is safe for their tenants to reside in. People living with dampness and mould have an increased risk of experiencing health problems.

Damp and Mould Health Issues

Like the majority of health risks, babies, children, the elderly and people with existing health conditions are most at risk of health issues caused by damp and mould. Damp and mould can result in:

  • Respiratory problems and infections, such as asthma
  • Coughing and wheezing
  • Skin conditions and irritation
  • Allergies
  • Weakened immune system

You may be eligible for a housing disrepair claim if you have reported the issue to your landlord, given them time to carry out the repairs, and they have failed to repair the property or ignored you.

If your case is successful, all legal fees are payable by the landlord. Should your case not be successful no claim for fees from you shall be made.

This makes this course of action one of the most accessible, tenant-friendly and risk-free actions available.

A full explanation in relation to the terms of our conditional fee agreements will be provided to you prior to the commencement of any action taken on your behalf.
