What is Parole?
Parole is the conditional release of a prisoner before the completion of their sentence. It allows prisoners to serve the remainder of their sentence under supervision in the community, provided they comply with specific licence conditions. The decision to grant parole is made by the Parole Board, which assesses the risk a prisoner might pose to the public if released.
What is the Process of Applying for Parole?
- Eligibility and Initial Application
Once a prisoner becomes eligible for parole, the government initiates the application on their behalf. The prisoner will receive an application form and the prison and probation service will submit reports including details of the prisoner’s time in custody and proposed licence conditions upon release. These documents are compiled into an information pack called a ‘dossier’.
Review and Supplementation
The prisoner and their legal representative review the dossier to ensure all the information is correct. The prisoner then has an opportunity to add further information to support their case for release, this can include personal statements, behaviour reports and any rehabilitative efforts. The legal representative can assist with drafting and submitting these reports.
- Submission to the Parole Board
Once the report is finalised it is sent to the Parole Board for consideration.
- Initial Assessment
A single Parole Board Member conducts an initial review of the report and any representations made by the prisoner or their legal representative. Based on the initial assessment, the Parole Board will either determine that the prisoner is eligible to be released on licence or if they require further time in custody. The Panel can also direct the matter to an oral hearing.
- Hearing and Decision
If a hearing is granted, it allows for a more detailed review and an opportunity for the prisoner and their representative to present their case in person. Professional witnesses such as prison offender managers and community offender managers will provide their opinions on release.
The Parole Board will make a final decision based on the hearing and the information presented. The decision will be confirmed within 14 days from the date of the hearing.
- Outcome
There are two possible outcomes:
Granted Parole: If parole is granted, the prisoner is released under specific conditions outlined by the Parole Board.
Refusal: If parole is denied, the prisoner will be informed of the reasons and any steps they need to take before reapplying.
